Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Landscaip website and the Landscaip landscape design service (the “Service”), operated by Landscaip (“Landscaip,” “we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Notify us promptly if you suspect unauthorized use of your account.

Landscaip lets you upload photos of a property and generate AI-assisted landscaping visualizations using style presets, custom prompts, generation settings, and in-painting edits. Renderings are illustrative and generated by an AI model. They are not architectural, horticultural, or engineering advice, and actual results, plant viability, and costs will vary. Always consult a qualified professional before beginning any landscaping work.

We may add, change, or remove features at any time, and we may impose limits on usage or storage to keep the Service reliable.

The Service runs on credits: one credit is consumed each time you generate a design, perform an in-painting edit, or re-prompt an image. Credits are made available through the following options, and current prices and inclusions are shown on our pricing page:

• Free credits: New accounts receive a set number of free credits on signup. The number and terms of free credits may change at our discretion.
• Credit packs: One-time purchases that add a fixed number of credits to your balance.
• Subscriptions: Recurring plans (Starter, Pro, and Business) that grant credits each billing period. Subscriptions renew automatically until cancelled, and you may cancel at any time from your account settings.
• Credit expiration: Purchased credits do not expire while your account is active. Credits granted by a subscription are governed by that plan’s terms.

Payments are processed by Stripe. By providing a payment method you authorize us to charge the applicable fees and any taxes. Prices are subject to change, and changes will not affect the current paid billing period.

Because credits are digital goods that are usable immediately, we do not provide refunds for used credits. If you believe you were charged in error, or a purchase failed to deliver credits, contact us at support@landscaip.co within the eligible window and we will review your request. Refunds, where granted, are returned to your original payment method.

You retain all rights to the photos and other inputs you upload (“User Content”). By using the Service you grant us a limited, worldwide, non-exclusive license to host, store, process, and transmit your User Content solely to operate and improve the Service — including sending it to our AI provider to generate renderings for you.

You represent that you have the rights necessary to upload your User Content and that it does not infringe the rights of any third party.

Subject to your compliance with these Terms and payment of applicable fees, you own the renderings and designs the Service generates from your User Content (“Output”). Because the Service is powered by AI, similar or identical Output may be generated for other users, and we make no guarantee that Output is unique. You are responsible for evaluating Output before relying on it.

You agree not to:

• Upload content you do not have the right to upload, or that infringes the intellectual property or privacy rights of others.
• Upload or generate content that is illegal, hateful, harassing, sexually explicit, or that depicts identifiable individuals without their consent.
• Reverse engineer, scrape, or attempt to extract the underlying model, prompts, or system behind the Service.
• Resell, redistribute, or provide access to the Service in a way that competes with it, or circumvent credit limits, pricing, or billing.
• Abuse, overload, or disrupt the Service or its infrastructure.

We may suspend or terminate accounts that violate these rules, and we may refuse or remove content at our discretion.

The Service relies on third-party providers — including Supabase (database, authentication, and storage), Google (AI generation via the Gemini API), Stripe (payments), and Vercel (hosting). Your use of the Service is also subject to their terms where applicable, and we are not responsible for their acts or omissions.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Output will meet your requirements.

To the maximum extent permitted by law, Landscaip will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

You agree to indemnify and hold harmless Landscaip from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that could cause harm. On termination, your right to use the Service ceases; certain provisions (including payment obligations, disclaimers, and limitations of liability) survive.

We may update these Terms from time to time. If we make material changes we will update the “Last updated” date above and, where reasonable, provide additional notice. Continuing to use the Service after the changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. You and Landscaip agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief to protect its intellectual property.
